My timing is a bit off, but, I find the comments regarding the Florida Supreme Court's decision typical and annoying. The comments are typical because Republicans, particularly James Baker, was a very effective advocate for the Bush team. He repeated the claim, ad nauseam, that you can't change the rules of the games after the game was played. That summarized Bush's position in a matter that could easily be propagated throughout the media. I ask how often was that phrase repeated in print and television? Unfortunately, it's a damn lie. What exactly did the court do that was "ex post facto"? The court resolved the ambiguous language (may/shall) in a prefectly reasonable manner. They used the authoriy of the Florida Constitution, particularly the "right to vote", to extend the recount period. Thus, preventing the extreme partisan, Katherine Harris, from stopping manual recounts all together. Where is the outrage for her decision? It was a clear abuse of discretion. She read the law in a manner most favorable to her party and not Florida voters.
The USSC vacated that Florida Supreme court decision on the grounds that the court could not use the Florida Constitution as authority in their decision. But, is extending the recount period, the "ex post facto" you noted?
It certainly couldn't have been the Florida Supreme court's second decision. On that decision, the USSC ruled it violated the "equal protection" clause. That is, different standards for different counties where identical voting equipment was used. But, by law, Florida delegates the authority to determine voter intent to the counties. The Florida Supreme court could not specify a common standard because that would have been a clear example of an "ex post facto" change. Thus, the equal protection violation was about Florida law, i.e. allowing different standards among counties, and not about the decision of the court.
By the way, I recently listened to Mark Ritchie, the current Minnesota Secretary of State, talking about the Florida "recount" with great joy. He described as a lesson on how to stop recounts. Finally, someone that cut through all the nonsense and got to the core. It was about stopping aa recount. But, you have to hand it to Republicans, they managed to stop a recount and tar the Florida Supreme court with shame. Dishonest, but politically effective.

I think its disgusting how Mr. Spacey, Mr. Toobin and Mr. Boyes can sit there and suggest for a minute that the HBO movie they made is somehow a neutral view of what happened. Their very comments show how biased they are. What happened was the Florida Supreme Court doing what it did... act like a legislature in an ex post facto manner - does that appear in the movie? That's what started it.... is this movie just a setup for a "count every vote" deal for Hillary Clinton? Come on, Charlie, how about having at least 1 non-biased commentator on there!!! How about having some guests on to say what really happened, Charlie.
